Welcome to Antoinette Atelier.

These Terms of Service ("Terms") apply when you visit our website, browse our collection, place an order or otherwise use the services made available through our online store.

Throughout these Terms, "Antoinette Atelier", "we", "us" and "our" refer to Antoinette Atelier.

Our online store is powered by Shopify, which provides the e-commerce platform through which we offer our artwork and related products.

By using our website or placing an order, you agree to these Terms together with our Privacy Policy, Shipping Policy and Returns, Refunds & Damages Policy.

Please read these Terms carefully before placing an order.


1. Using Our Website

You may use our website for lawful purposes and to browse, learn about and purchase artwork offered by Antoinette Atelier.

By placing an order, you confirm that you have the legal capacity to enter into a binding transaction and that the information you provide to us is accurate, current and complete.

If you create a customer account, you are responsible for maintaining the confidentiality of your login information and for activity carried out through your account.

You must notify us if you become aware of any unauthorised use of your account.

 

2. Our Artwork and Product Information

We take reasonable care to describe and present our artwork accurately.

Product pages may include information such as the artwork design, dimensions, format, materials, finish, framing options and other relevant characteristics.

Please review the product description and dimensions carefully before placing your order.

Some artworks may be printed, prepared, finished or framed after an order is placed.

We reserve the right to update product descriptions, specifications, availability and other information on our website where reasonably necessary.

 

3. Colour and Display Differences

We make every reasonable effort to represent artwork and colours accurately on our website.

However, the appearance of colours may vary depending on factors including:

  • the device or screen being used;
  • display settings and screen brightness;
  • surrounding lighting;
  • photography;
  • printing methods;
  • materials and surfaces; and
  • the lighting in which the finished artwork is viewed.

Minor differences between the appearance of artwork on a screen and the physical artwork are therefore not necessarily defects.

If an artwork is materially different from what was ordered or represented on our website, please contact us in accordance with our Returns, Refunds & Damages Policy.

 

4. Hand-Finished and Artistic Variations

Certain artworks may contain hand-applied, hand-finished or individually crafted elements.

Where applicable, subtle variations may occur in brushwork, texture, pigment, metallic effects, placement, finish or other artistic details.

These variations are part of the individual character of the artwork and do not ordinarily constitute defects.

 

5. Orders

When you submit an order through our website, you are offering to purchase the selected items subject to these Terms.

You will be given an opportunity to review your order information before confirming your purchase.

Please check your:

  • selected artwork;
  • size and format;
  • quantity;
  • delivery information; and
  • contact details

carefully before completing your order.

An automated order confirmation acknowledges that we have received your order. We reserve the right to decline or cancel an order before fulfilment where reasonably necessary, including where:

  • an artwork or option is unavailable;
  • there is an obvious pricing or product information error;
  • payment cannot be authorised or verified;
  • we reasonably suspect fraud or misuse; or
  • we are unable to fulfil the order for another legitimate reason.

If we cancel an order after payment has been received, any amount paid for the cancelled item will be refunded.

 

6. Order Cancellations

If you wish to cancel an order, please contact us within 24 hours of placing your order.

Where preparation or production has not yet begun, we will make reasonable efforts to cancel the order.

Once preparation or production has begun, or the order has been dispatched, cancellation may no longer be possible.

7. Prices and Payment

The price payable for an artwork will be the price displayed on our website at the time you place your order, subject to correction of obvious errors.

Any applicable delivery charges or other charges relating to your order will be displayed or communicated before you confirm the transaction where required.

Prices and promotions may change from time to time, but changes will not ordinarily affect orders that have already been confirmed.

Payment must be made using one of the payment methods made available through our checkout.

You confirm that you are authorised to use the payment method provided for your purchase.

Payments may be processed by Shopify and/or third-party payment service providers. Antoinette Atelier does not generally receive or store complete payment card credentials.

 

8. Promotions and Offers

From time to time, we may offer promotions, discounts or special offers.

Additional conditions may apply to a particular promotion and will be communicated with the relevant offer where applicable. Promotions may be subject to:

  • specified validity periods;
  • availability;
  • eligibility requirements;
  • minimum order values;
  • product exclusions; or
  • other stated conditions.

Unless expressly stated otherwise, promotional offers cannot be combined.

 

9. Shipping and Delivery

Antoinette Atelier currently accepts website orders for delivery within Sri Lanka only.

Available delivery methods and applicable delivery charges will be displayed or communicated before your order is confirmed.

Any delivery time provided is an estimate rather than a guarantee unless we expressly state otherwise.

We take reasonable steps to prepare and dispatch orders within the estimated timeframe and use appropriate delivery providers. However, delays may occasionally occur due to circumstances outside our reasonable control.

You are responsible for providing a complete and accurate delivery address and contact information.

Where delivery cannot be completed because incorrect or incomplete information was supplied by the customer, or because the recipient is unavailable despite reasonable delivery attempts, additional delivery or re-delivery costs may apply.

If an artwork arrives damaged, defective or incorrect, please follow the procedure set out in our Returns, Refunds & Damages Policy.

 

10. Returns, Refunds and Damaged Artwork

Returns, cancellations, refunds and claims relating to damaged, defective or incorrect artwork are governed by our Returns, Refunds & Damages Policy, which forms part of these Terms.

Because artwork is delicate and may be affected by repeated handling and transportation, Antoinette Atelier does not offer general change-of-mind returns once an artwork has been delivered in good condition and in accordance with the customer's order.

Nothing in these Terms is intended to remove any responsibility that Antoinette Atelier is required to assume under applicable law.

 

11. Care, Handling and Installation

Artwork should be handled, stored, displayed and installed with appropriate care.

Antoinette Atelier is not responsible for damage arising after successful delivery as a result of circumstances outside our control, including improper handling, cleaning, storage, installation, mounting, framing, accidental damage or exposure to unsuitable environmental conditions.

Where care or installation guidance is provided with an artwork, we recommend following that guidance.

 

12. Intellectual Property and Ownership of Artwork

All intellectual property associated with Antoinette Atelier and our website is protected by applicable intellectual property laws.

This may include:

  • original artworks and designs;
  • illustrations;
  • photographs and product images;
  • graphics;
  • patterns and compositions;
  • written content;
  • branding;
  • logos;
  • trade names;
  • website design; and
  • other creative material displayed through our website or associated with Antoinette Atelier.

Unless otherwise stated, this material is owned by Antoinette Atelier, the relevant artist or another party that has authorised its use.

 

Purchasing an Artwork Does Not Transfer Copyright

When you purchase an artwork from Antoinette Atelier, you acquire ownership of the physical artwork or physical product supplied to you.

You do not acquire copyright, reproduction rights or any other intellectual property rights in the underlying artwork or design unless we expressly agree otherwise in writing.

The purchase of an artwork therefore does not give permission to reproduce, copy, manufacture, adapt or commercially exploit the artwork.

Without prior written permission, you must not:

  • reproduce an artwork as a print, poster, canvas or other product;
  • scan or create high-resolution reproductions of an artwork for distribution;
  • use our artwork on merchandise, clothing, packaging or commercial products;
  • create or sell substantially copied or derivative versions of our artwork;
  • distribute or sell digital copies of our artwork;
  • use artwork or website imagery for commercial advertising or branding;
  • mint or commercially exploit our artwork as an NFT or similar digital asset;
  • include our artwork or website content in commercial datasets; or
  • use our artwork or website imagery to train, develop or improve artificial intelligence or machine learning systems without our written permission.

You may photograph artwork you have purchased for ordinary personal and non-commercial purposes, including sharing photographs of the artwork displayed in your home or space.

Nothing in these Terms prevents uses that are expressly permitted by applicable law.

 

13. Use of Website Content

We grant you a limited, revocable and non-exclusive right to access and use our website for personal browsing and shopping.

You may not copy, reproduce, republish, distribute, sell, commercially exploit or systematically extract substantial portions of our website or its content without our prior written permission.

You must not use automated scraping, data extraction, bots or similar technologies to collect artwork, images, product information or other website content for commercial exploitation, dataset creation or artificial-intelligence training without our permission.

 

14. Prohibited Uses

You must not use our website:

  • for an unlawful or fraudulent purpose;
  • to infringe our intellectual property rights or those of another person;
  • to impersonate another person or provide deliberately false information;
  • to attempt unauthorised access to our website, accounts or systems;
  • to introduce viruses, malicious software or harmful code;
  • to interfere with the security or proper operation of the website;
  • to collect personal information about other users without lawful authority;
  • to send spam or other unauthorised communications through our services; or
  • in any manner intended to damage, disable or misuse our website or services.

We may restrict or suspend access where we reasonably believe these Terms have been seriously violated.

 

15. Reviews and Customer Content

Where our website allows customers to submit reviews, comments, photographs or other content, submissions should reflect genuine experiences and must not be unlawful, abusive, misleading, defamatory or infringe the rights of another person.

We will not knowingly publish fabricated reviews or manipulate reviews in order to create a misleading impression of our products or services.

We may moderate or remove content where reasonably necessary because it:

  • contains unlawful or abusive material;
  • discloses private information;
  • infringes intellectual property rights;
  • contains spam or unrelated promotional material; or
  • is unrelated to a genuine customer experience.

Negative feedback will not be removed merely because it is negative.

Third-party websites and services are operated independently from Antoinette Atelier and may be subject to their own terms and privacy policies.

17. Relationship with Shopify

Antoinette Atelier is powered by Shopify, which enables us to provide our online store and related services.

However, any sale or purchase made through our store is made directly between you and Antoinette Atelier.

Shopify is not the seller of the artwork purchased through our store and is not responsible for the fulfilment of purchases made from Antoinette Atelier.

To the fullest extent permitted by applicable law, Shopify and its affiliates are not responsible for claims, loss or damage arising from or relating to purchases and transactions made directly with Antoinette Atelier.

 

18. Privacy

Our collection and use of personal information is governed by our Privacy Policy.

Because our online store is hosted by Shopify, certain personal information may also be collected and processed by Shopify in connection with your use of the website and checkout.

Please review our Privacy Policy for further information about how personal information is collected, used, disclosed and protected.

 

19. Errors and Website Information

Occasionally, information on our website may contain typographical errors, technical errors or inaccuracies relating to matters such as:

  • product descriptions;
  • dimensions;

We reserve the right to correct genuine errors and update website information.

If an obvious error affects an order you have already placed and prevents us from fulfilling it on the terms presented, we will contact you before proceeding. Where appropriate, you will be given the option to accept the corrected information or receive a refund for the affected item.

Antoinette Atelier does not exclude responsibility for matters for which liability cannot lawfully be excluded.

Subject to that principle and to the fullest extent permitted by applicable law, Antoinette Atelier will not be responsible for indirect, incidental or consequential losses arising solely from the use or inability to use our website.

Nothing in this section removes our obligations relating to artwork that is damaged, defective, incorrect or otherwise subject to a remedy under our policies or applicable law.

 

22. Complaints and Dispute Resolution

If you have a concern regarding an order or our services, we encourage you to contact us first so that we can review the matter and attempt to resolve it fairly.

We will make reasonable efforts to review and respond to genuine customer concerns.

If a dispute cannot be resolved directly, you may pursue any complaint, dispute-resolution or redress options available to you under applicable Sri Lankan law, including through the appropriate consumer or judicial authorities.

 

23. Governing Law

These Terms and purchases made through the Antoinette Atelier website are governed by the laws of Sri Lanka, except where applicable law requires otherwise.

Any dispute that cannot be resolved directly between us may be submitted to a court or other authority of competent jurisdiction in Sri Lanka.

 

24. Changes to These Terms

We may update these Terms from time to time to reflect changes to our business, website, policies, products, technology or legal requirements.

The current version will be published on this page together with the date it was last updated.

Changes will apply from the effective date of the updated Terms and will not ordinarily alter the terms applicable to a purchase already confirmed before that date, unless required by law.

If any part of these Terms is determined to be unlawful, invalid or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.

Our failure to enforce a provision of these Terms on one occasion does not mean that we permanently waive the right to enforce it.

These Terms, together with our Privacy Policy, Shipping Policy, Returns, Refunds & Damages Policy and any other terms specifically presented to you in connection with an order, form the terms applicable to your use of our website and purchases through it.
